1. Acceptance of Terms
These Terms of Service (“Terms”) govern your use of the Sona device, mobile application, and related services (“Sona” or the “Service”). By using Sona, you acknowledge that you have read and agree to these Terms. If you do not agree, you must not use the device or app. We may update these Terms from time to time and will notify users of any material changes (e.g. via our app or website); continued use of Sona after changes means you accept the revised Terms.

2. Account Registration and Eligibility
To use Sona, you must create a user account with accurate personal information. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. You agree to notify us immediately of any unauthorized use of your account. You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account. Individuals under 18 may only use Sona under the supervision and consent of a parent or legal guardian (we do 
not permit use by children under 13 in compliance with child data protection laws. We reserve the right to refuse service or terminate accounts if these Terms are violated.

3. Personal Wellness Use – No Medical Advice
Sona is intended for 
personal wellness and relaxation purposes only. It is not a medical device, and Sona’s content and feedback do not constitute medical advice. Neither the Sona device nor the app is intended to diagnose, treat, cure, or prevent any disease or medical condition. Always consult a qualified healthcare professional for any health concerns or before making medical decisions. In particular, if you have any preexisting medical condition or an implanted electronic device (such as a pacemaker), consult your physician before using Sona. You should never disregard professional medical advice or delay seeking it because of any measurements or content from Sona.

4. Proper Use of the Device
Use Sona only as directed in the user guide. Do not attempt to modify, disassemble, or misuse the device or app. You are responsible for ensuring that the device is used safely and correctly. We are not liable for any injury or damages resulting from misuse or unauthorized modifications. 
Sona’s relaxation and biometric feedback features are for informational and self-improvement purposes, to help you track metrics like heart rate variability, breathing rate, and stress indicators, but these metrics should not be interpreted as medical diagnoses.

5. Privacy and Data
Your use of Sona is also governed by our 
Privacy Policy (see below), which explains what data we collect and how we use and protect it. By using Sona, you agree that we can collect and process your data in accordance with that Privacy Policy. In summary, Sona collects certain personal information and biometric data (such as heart rate, HRV, breathing rate) in order to provide you with the Service. We do not share your personal data with third-party companies or apps for their own use without your consent. We also do not sell your personal data to third parties. All data is handled in compliance with applicable privacy laws GDPR, UK Data Protection Act, CCPA. You retain ownership of the data you generate with Sona, and you can request deletion of your data at any time as described in the Privacy Policy.

6. Free Service and Changes
Currently, accessing the Sona app and cloud service is 
free of charge – there are no subscription fees for standard features. (Your purchase of the Sona device covers the hardware; the accompanying app and basic services are included at no extra cost.) We may introduce premium features or fees in the future, but any such changes will be communicated in advance, and you will not be charged without your explicit agreement. We reserve the right to modify or discontinue certain features or the free nature of the Service, but will provide notice if any material changes are made. Rest assured that even as a free service, we remain committed to never monetizing your personal data (for example, we will not sell personal data to advertisers as a means of profit).

7. Intellectual Property
All content, software, and trademarks in the Sona device and app are owned by us or our licensors. We grant you a limited, revocable license to use Sona for its intended wellness purposes. You must not copy, reverse-engineer, distribute, or create derivative works from our software or content without permission. Any feedback or suggestions you provide to us may be used to improve Sona, and we have the right to incorporate such feedback without obligation to you.

8. Limitation of Liability
Sona is provided “as is” without any express or implied warranties. While we strive for accuracy and uptime, we do not guarantee that the Service will be error-free or uninterrupted. To the maximum extent permitted by law, 
we are not liable for any indirect, incidental, or consequential damages arising from your use of Sona. In jurisdictions that do not allow certain liability exclusions, our liability will be limited to the extent permitted by law. Importantly, because Sona is not a medical device, we are not liable for any health outcomes; you assume all responsibility for how you use the wellness information Sona provides. Use the device as directed, and if you experience any adverse effects or have concerns, stop using and consult a doctor immediately.

9. Governing Law
These Terms are governed by the laws of [
Your Country/Region]. If you are a consumer in the UK or EU, you may have certain rights under local consumer laws which are not overridden by this agreement. Any disputes arising from these Terms or your use of Sona shall be subject to the jurisdiction of the courts of [Your Country], unless applicable laws require otherwise. We prefer to resolve any concerns or disputes amicably – please contact us if you have an issue.

10. Termination
You may stop using Sona and/or delete your account at any time. We reserve the right to suspend or terminate your access to Sona if you violate these Terms or if we are required to do so for legal reasons. Upon termination, your rights to use the Service will cease, but sections of these Terms that by their nature should survive (such as disclaimers of liability and jurisdiction) will remain in effect.
